Privacy Statement

We appreciate your trust and make every effort to protect your privacy. This privacy statement makes clear why we collect certain information and how we protect your privacy.

NextBI B.V. (hereinafter referred to as NextBI) is located at Startbaan 6 in Amstelveen (1185 XR). To ensure that we act in accordance with applicable privacy laws, we have appointed a data protection officer (FG). This Statement applies to our processing of data of customers or their employees who use our service (category (a) or persons we approach to become customers (category b).

NextBI is a data service provider focused on the B2B sector. This means that we collect various types of data from organizations that actively participate in commerce and are registered in the Trade Register, we combine data and provide it to companies. In carrying out our work, we also process personal data. We distinguish between four categories in processing them.

Category 1 – personal data from public records
NextBI unlocks, aggregates and enriches data from various public sources and registers, such as the Trade Register and the BAG, to fulfill its services to its clients. The purpose and operation of these registers are regulated by law, including the promotion and safeguarding of legal security and commerce.

We make this data available to business customers online, through technical integrations (APIs) and as individual files.

Category 2 – personal data from data partners
In addition to public records, NextBI also unlocks and delivers data from its data partners. Consider, for example, international business information.

Category 3 – personal data of NextBI customers
Some clients have their own (customer) data supplemented or analyzed by NextBI. Among that data provided by customers may be personal data. NextBI then delivers the enriched data back, often providing advice, such as how the client compares to industry peers or where the biggest risks and/or opportunities are. In this case, NextBI is acting as a Processor.

Category 4 – personal data of NextBI relations
Within the scope of executing agreements with customers and optimizing our services, we also process (personal) data of our customers and relations.

We do not process any special personal data including race, ethnicity, political views, memberships, health data and/or religious or philosophical beliefs. We do not accept assignments that require the collection of special personal data.

For what purposes do we process personal data and which are they?

When you use our services (category a)

a) To conclude and perform agreements
When your company purchases a service from us as a customer, we process your company data for administrative purposes, such as sending invoices. If you are a sole proprietor, your business records may include personal information (if you have offices at your home address, for example).
We also process personal data from you, your employees or associates to enable them to use our service, for example, to allow them to log in to our online services or when our customer service representatives are speaking to you or them.

For this purpose, we process contact data of our customers, such as address, phone number and e-mail address, and personal data of our users, such as name and IP address. We limit ourselves to information necessary to properly perform our agreement to the satisfaction of you, the customer.

We perform this processing on the basis of “performance of contract.

In some cases, we also process customer data to comply with laws and regulations, such as tax laws. In these cases, we may need to disclose your personal data to government agencies or regulatory authorities.

We then do so on the basis of “legal obligation.

(b) To monitor the use of our services.
We also process personal data to monitor the use of our services. We do so partly to use that information to make our online services work even better and to offer you certain new features of our services, but also to record total usage, for example, to calculate fees due based on that information.

For this purpose, we process personal data automatically generated by the functionalities you have used on our website and the technical data of your device, such as the IP address, the Internet browser you use, the pages you have visited on our website, your click and surfing behavior and length of your sessions.

We do this processing on the basis of “legitimate interest. This is because the use of personal data as described above is necessary to provide and protect the best possible service to our customers and users. In doing so, we have taken various measures to prevent the invasion of our users’ privacy as much as possible and, where unavoidable, to limit this impact, such as those described below in this Privacy Statement.

When you do not use our service (yet) (category b)

Even if you are not yet a customer of ours, but are interested in our services and, for example, have created a free account on one of our web shops or filled out a form via our websites, we register your data. This may include personal data, such as IP address. We also use cookies for this purpose, see below in this Privacy Statement.

We also process the personal data of potential customers in our customer contact to deal with them. We get the data from public sources and our own marketing database. We obtain additional information from data subject in conversations we have with contacts at the relevant organization.

All information, both from existing customers (category (a) as possible future relationships (category (b) that we use in our own marketing we store in our marketing automation platform. We use that information to provide you with suitable offers and to send you (personalized) newsletters, as well as providing customer service and performing account management. We also use your personal data to develop, conduct and analyze market research and marketing strategies. We also use internal reports/dashboards to monitor status and progress of market operations at an aggregate level.

If we approach you with personalized marketing, we always do so only after you have been clearly informed about this in advance and have also given your explicit consent. You can also revoke that permission at any time.

For processing personal data for non-personalized management and marketing, we rely on the basis of “legitimate interest.

Cookies

If you visit our website www.nextbi.nl or www.mijndoelgroep.nl, we also collect your personal data through the use of cookies. Cookies are small files of information that store and retrieve data about your visit – for example, how you came to our site, how you navigated the site and what information was of interest to you.

Rights of data subjects

The AVG provides data subjects with a number of rights.

  • Information and inspection
    You can see what personal data we process about you and we can explain for what purpose NextBI does so.
  • Change
    If the personal information NextBI has registered about you is incorrect and you wish to update it, you may make it known via the above phone number or email address.
  • Oblivion
    You have the right to have us delete the personal data we hold about you. We may then still need to process that data for other purposes such as administration or exclusion.
  • Restriction
    If you believe NextBI is processing personal data unlawfully or improperly, you can have that processing restricted. You have the right to stop (temporarily) the processing of your personal data.
  • Objection (opposition)
    You may object to the processing of your personal data. If it is marketing or CRM, we will terminate that processing of your personal data as soon as possible.
  • Portability
    If you wish to have your personal data transferred, you may submit a request to NextBI to do so.
  • Automated decision-making
    The right to have your data excluded from automated individual decision-making. In other words, the right to a human eye in decision-making.

To invoke your right to access, rectification, deletion, restriction, objection or data portability, please contact us at +31(0)88-028 38 00 or by email at gegevensbescherming@nextbi.nl. For proper processing, please attach a copy of your valid ID and an excerpt from the Chamber of Commerce of your organization or the organization where you work. With the government’s KopieID app, you can easily make a secure copy of your ID and NextBI does not need to process any additional personal data, such as a BSN, from you.

In addition to the above rights, you also have the right to withdraw your consent to the processing of your personal data at any time.

How is the protection of your personal data guaranteed?

NextBI has safeguards in place to ensure the confidentiality and security of your personal information. We have implemented technical, physical and organizational measures to protect personal data against accidental or unlawful destruction or loss, damage, alteration, unauthorized disclosure or access, as well as all other forms of unlawful processing (including, but not limited to, unnecessary collection) or further processing.

How does NextBI ensure that your personal data is accurate?

Naturally, we are committed to ensuring that the data we process about you is accurate. If you identify any data that is incorrect, we would of course like to hear about it at gegevensbescherming@nextbi.nl.

Do you have a complaint about the use of your personal data? If so, you can also file this complaint with the Personal Data Authority (AP).

Retention periods

Customers
We keep our customers’ personal data as long as necessary to provide our services, fulfill our agreements or as long as necessary to comply with legal obligations. In any case, we do not keep personal data longer than necessary.

Organizations
In order to ensure minimal data processing, we do not keep organizations’ data longer than necessary to achieve our goals.

NextBI as a processor

As regards the personal data that our customers provide to us or record in our online services, NextBI should be regarded as a processor and the customer as a data controller within the meaning of the AVG.

Under the AVG, controllers and processors must enter into a written agreement that governs the processor’s processing of personal data in accordance with the requirements of the AVG. This agreement is otherwise free of form. NextBI has chosen to incorporate this processor agreement in full into its General Terms and Conditions which apply to all deliveries of our services. By accepting the Terms and Conditions, our customers also agree to the contents of the processor agreement. In situations where there are industry-specific requirements for the processor agreement that are not included in our Appendix Processor Agreement, an individual processor agreement can be drafted. To this end, the FG may be contacted at gegevensbescherming@nextbi.nl.

Changes

NextBI will update its privacy statement according to changes in the law. Therefore, check our website regularly to make sure you are still completely up to date.

NextBI is a member of the Association for Business B2B Information (VVZBI). Together, we ensure legal certainty in economic life. As an association, we have a Privacy Code of Conduct to which we and other members fully confirm.
